The Ministry of Law and Justice (MoL&J), on August 6, 2026, notified the Registration of Births and Deaths (Amendment) Act, 2026, amending the Registration of Births and Deaths Act, 1969. The amendment revises the procedure for registration of births and deaths reported after the prescribed timelines and will come into force on a date to be notified by the Central Government.
Under the amendment, delayed registration of a birth or death after one year but within two years of its occurrence will require an order of the District Magistrate, Sub-Divisional Magistrate, or an Executive Magistrate authorised by the District Magistrate, after verification of the facts and payment of the prescribed fee. The amendment also clarifies that "Executive Magistrate" refers to an Executive Magistrate appointed under the Bharatiya Nagarik Suraksha Sanhita, 2023.
Further, where the delayed information is furnished after two years from the occurrence of the birth or death, registration will be permitted only on an order of the Judicial Magistrate of the First Class having jurisdiction over the area where the event occurred, following verification and payment of the prescribed fee.
